Hi All,
I got my COS from H4 to F1 approved in first semester itself (Fed-2010), now my questions is I don�t have plans for going to India in next couple of years so after completing my masters can I apply for OPT without having the F1 Visa stamping OR should I have to get F1 Visa stamping in India in order to get the OPT after my masters.
my wife got OPT based on COS from H4 to F1 (no stamping).

For those worried about not being able to live in the UK, I say "Don't worry, you are not missing a great deal".
I have lived & worked in UK for a couple of years many years back. Like most of my acquaintances at that time I didn't (want to) live there long. Most of my friends left for US, I returned to India. And then to US.
Life is US has its problems, the immigration backlog is one of them. But it is really a walk in the park compared to that in Britain. UK is one of the most racist society I have ever seen. There is racism in all countries (even in India, we call it Casteism) but no where as overt as in UK. In UK, the work culture isn't all that great, life is boring and the weather sucks. No wonder a recent investigation by BBC reported that 7 out of 10 Britons now prefer to live outside UK mainly because it's high cost of living, lack of livable space and for little more sunshine. And that number is growing every year. In % terms, that's the highest number and in absolute terms it is the 3rd highest expat population of any country, only India & China ranks higher. Britons now prefer the sunny & more livable places such as Spain (culture), Australia (language) and Florida (proximity).
When I left UK, it was with relief. Now when I visit UK on work or enroute to other countries, I feel sorry for the folks back there. I would any day prefer living in India - if not in US - than living in UK.

You are just guessing that he was the reason that our SKIL bill or even a minor reform was not included in latest enformance only bills. I have personally read different point of views here. Mathew Oh's website said House wanted to include some measure but were not allowed to include piecemeal immigration legislations.
I guess only core members will only know who supports us and who does not.

Under Premium Processing you would certainly get a response which can be a Denial or an Approval within 2 weeks.if you are lucky enough you might get a response within 4-5 business days.

I have filed for I-485. I am also extending my H1B. I have an approved I-140. Can I extend for 3 years? Or is it just 1 year assuming my 6 years are completed.

With a one-year residency requirement in Georgia, with an H-1 visa, you should qualify for in-state tuition.
It worked in our case, but that was a couple of years ago.
In all the big ones like GA Tech, UGA and GSU, the admissions counsellors and the registrar's office are pretty clued into this issue.

A rather alarming report, detailed in the Los Angeles Times (http://immigrationvoice.org/www.latimes.com/news/local/la-me-customs-audit-20101228,0,2191445.story), shows that new travel restrictions requiring passports for American citizens to reenter the country are not being enforced.
These are American citizens, so perhaps we should not get too excited about the report, but it still makes you wonder about travel enforcement in general. Here are excerpts from the article:
Despite new travel requirements, more than 2.3 million Americans reentering the country by land or sea from Mexico or Canada failed to produce a passport, birth certificate or other secure document to establish identity and nationality, a government review has found.
Most people, including about 500,000 in California, were allowed to pass through ports of entry without the approved documents or without being sent to a secondary inspection post for a more in-depth examination, according to the report by the inspector general for the Department of Homeland Security.
Many travelers were allowed to pass after undergoing extensive questioning and producing at least a driver's license, the report found. Overall, 96% of travelers arriving at the 39 busiest land ports were in compliance with the new law, which took effect in June 2009.
The procedure for processing those without the required documents needs to be more precise and implemented across the board, the report said.
The Western Hemisphere Travel Initiative, approved by Congress last year, requires U.S. travelers reentering the country from Mexico or Canada to present documents, such as a passport or birth certificate, to U.S. Customs and Border Protection officers.

I am on F1 visa. I enrolled in one of the university. I don't attend university in person. I do attend classes online from another state. My question is that I am resident of which state ?? Will I be automatically resident of state where exactly my university is ? I know it is mandatory to attend classes in person on F1. Can you please advise ? How is residency considered ?

labor is indeed more than 1 year old. Are you completely sure about this rule since having an approved 140 gives you a 3 year extemsion
Yes, unfortunately you are not eligible for I140 premium processing as you can extend your H1 beyond 6 yrs based on labor > 1yr old.
USCIS opened this premium processing for a VERY narrow group of people: "who can not extend H1 visa beyond 6 yrs by any other means, who are currently on H1 status". However, due to this very narrow inclusion criteria, they have received a very few premium processing requests (as most people either have older labor or are in different status by now). And they LOVE money, so they will soon come up with broader premium processing, (probably in october or so when new fiscal year starts when they usually go in "hibernation")

I got my GC but my wife's application (based on my 485) is still pending. I think at this point I can switch jobs/go to school full time and it won't affect my spouse's case. Just want to double check on this, any thoughts??
